SUBSTITUTE TRUSTEE'S NOTICE OF SALE Notice is hereby given that on the 1st of August, 2019 beginning at 10:00 a.m. at the front of the Sullivan County Courthouse located at 3411 Highway 126 in Blountville, Tennessee, the undersigned, in his capacity as Substitute Trustee, having been so appointed by an Appointment of Substitute Trustee of record in the Register's Office for Sullivan County, Tennessee, in Book 3340, Page 1473, under the Deed of Trust executed by Kevin Morrell and Vivian M. Morrell (collectively the "Grantors") to Robert H. Williams and Daniel M. Ledford (collectively the "Trustees"), dated November 17, 2011 (the "Deed of Trust"), of record in said Register's Office in Book 3014, Page 1727, by reason of default in the payment of the obligations secured by the Deed of Trust described above and the performance of the covenants contained therein, will sell at public auction to the highest bidder for cash, the interest conveyed to said Substitute Trustee by the Deed of Trust against the property therein described (the "Property"), to-wit: Situate in the Sixteenth (16th) Civil District of Sullivan County, Tennessee, to-wit: BEGINNING at a chestnut oak, Sharp's corner; thence a division line, four courses: N. 40 degrees W 34 rods to a stake; N 19 degrees W 23 18/25 rods to a hickory at a slide; thence N 35 1/2 degrees W 52 rods to a chestnut oak stump on a north side of a ridge, and 2 rods from red oak line; thence with Baumgardner's line N 60 degrees E 30 19/25 rods to a stake, Shipley's corner; thence with his line S 45 degrees E 28 rods to a chestnut oak; thence S 52 degrees E 30 rods to a chestnut oak; thence S 38 degrees E 13 rods to a chestnut oak; thence S 38 degrees E 13 rods to a red oak; thence S 01 degrees E 30 rods to Massengill's corner; thence with Massengills' line, S 35 degrees E 22 1/2 rods to a black oak (formerly identified as Chestnut Oak); thence S 2 degrees W 18 rods to a dogwood corner at the road; thence with Sharp's line S 2 degrees W 7 1/2 rods to a pine; thence S 55 degrees W 14 rods to a chestnut oak; thence S 26 degrees 7 6/25 rods to the beginning, containing 33 3/4 acres, more or less. This also includes a right-of-way across Share No. 1 as the road is now located. There is excepted from the above-described property, the parcels conveyed to Ricky Lynn Jackson and wife, by Deed of record in the Office of the Register of Deeds for Sullivan County, at Blountville, Tennessee, in Deed Book 843C, at page 40. Being the same property conveyed to Kevin Keith Morrell, by Quitclaim Deed dated March 22, 2001, from Kevin Morrell, a single man and Edward E. Morrell and wife, Dorothy Jane Morrell, which appears of record in the aforesaid Register's Office in Deed Book 1606C, at page 286. Tax Map. No. 125 Parcel No. 21.00 Property Address: 160 Carr Hollow Road, Bluff City, TN 37618 THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under the terms of the Deed of Trust, the Grantors waived all right of homestead, equity of redemption, statutory right of redemption, and relinquished all other rights and exemptions of every kind, including, but not limited to, a statutory right to an elective share in the Property. The sale is subject to any restrictions, reservations, and conditions of record applicable to the Property, deeds of easement, etc., if any, and any unpaid county and/or city taxes against the Property. TERMS OF SALE: CASH (10% deposit due on day of sale, balance due in full at closing within fifteen (15) days from day of sale). Purchaser shall pay all recording fees and taxes, examination of title settlement fees, and all costs of conveyance, including preparation of a Substitute Trustee's deed. The Substitute Trustee's deed shall be made without any covenant or warranty either express or implied. The Substitute Trustee reserves the right to take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, the Substitute Trustee also reserves the right to reopen the bidding or republish and sell the Property at his option. The beneficiary named in the Deed of Trust may become the purchaser at the sale. The Substitute Trustee shall apply the sale's proceeds in accordance with the provisions of the Deed of Trust. The Substitute Trustee reserves the right to waive the deposit requirement, to extend the period of time within which the Purchaser is to make full payment, to withdraw the Property from sale at any time prior to the termination of bidding, to keep the bidding open for any length of time, or to reject all bids. The Substitute Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.
